By downloading, installing, or using FirstChapter ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and FirstChapter.
FirstChapter is an AI-powered baby journal application that allows parents to capture and preserve memories of their children's early years. The App provides voice-first memory capture, AI-generated journal entries, photo and video storage, family sharing, and memory book creation.
You must be at least 18 years old to create an account and use FirstChapter. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. The App is designed for parents and caregivers to document their children's lives.
To use FirstChapter, you must create an account using a valid email address or Apple Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
FirstChapter offers the following plans:
Recurring subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your device's app store settings. Refunds are handled by Apple or Google in accordance with their respective refund policies.
You retain full ownership of all content you create, upload, or record using FirstChapter, including voice recordings, journal entries, photos, and videos ("User Content"). By using the App, you grant FirstChapter a limited, non-exclusive, royalty-free license to process, store, and display your User Content solely for the purpose of providing and improving the service.
You are solely responsible for your User Content. You represent that you have the right to share any content you upload and that your content does not violate the rights of any third party.
We will never use your User Content for advertising, sell it to third parties, or use it to train AI models.
You agree not to use FirstChapter to:
FirstChapter uses artificial intelligence to generate journal entries from your voice recordings and text input. While we strive for accuracy and quality, AI-generated content may occasionally contain errors or inaccuracies. You are encouraged to review and edit all AI-generated content. FirstChapter is not responsible for the accuracy of AI-generated entries.
The App, including its design, features, code, and branding, is owned by FirstChapter and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.
We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to other users or the service. You may delete your account at any time from the Account settings. Upon account deletion, all your data will be permanently removed in accordance with our Privacy Policy.
FirstChapter is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, FirstChapter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the App. Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.
You agree to indemnify and hold harmless FirstChapter, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App, your User Content, or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
We may update these Terms from time to time. We will notify you of material changes by email or through the App. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
